Service Agreement (Overnight Stay / Daycare)

  1. DISCLOSURE: For the purposes of this Agreement, the terms “Pet” or “Pets” refer to all pets under said ownership of Owner who utilize services at Furmummy, either now or in the future (“Services”).
    By signing this Agreement and leaving Pet with Furmummy, Owner warrants and represents to Furmummy that all information provided to Furmummy either in writing or orally about the Pet including without limitation information relating to health, satisfaction of pre-arrival checklist and sole ownership of the Pet is accurate in all respects and further acknowledges that this is a continuing warranty and representation that shall be deemed repeated each time his Pet is brought to Furmummy.
    Owner agrees to inform Furmummy of any changes in Pet’s condition and/or behaviour no less than three (3) days prior to subsequent visits. Furmummy reserves the right to refuse service to any Pet for any reason, at any time, including, but not limited to: pets lacking proof of vaccinations, displaying signs of untreated or potentially contagious conditions and/or exhibiting aggressive or unacceptable behaviour.
  2. RATES: The rates quoted on the invoices issued to Owner are based on the period of stay of the Pet (“Service Fees”). Rates are subject to change as a result of changes in Pet arrival and/or departure dates and updated on Furmummy from time to time. Rates quoted are in Singapore Dollars. Rates do not include any applicable prevailing government taxes at time of occupancy.
    Furmummy reserves the right to charge a handling fee for aggressive and/or hyperactive Pet, and grooming fees for Pet with needs to be cleaned or groomed during stay due to any incidents, at any time, in addition to the rates quoted on the invoices.
    All payments made by the Owner will be made free from any restriction or condition and be made without deduction or withholding for or on account of any present or future taxes, duties, assessments or governmental charges of whatever nature imposed or levied by or on behalf of any authority thereof or therein having power to tax, unless deduction or withholding of such taxes, duties, assessments or governmental charges is compelled by law. In such event, the Owner will pay such additional amounts as will result in the receipt by the Furmummy of the net amounts after such deduction or withholding equal to the amounts which would otherwise have been receivable by the Furmummy had no such deduction or withholding been required.
    In the event the Owner completes a booking based on a rate that has been incorrectly posted or amends the booking to a lesser number of days, Furmummy reserves the right to amend the rate or cancel the booking at its sole and absolute discretion, and will contact the owner directly to do so. The Owner agrees to pay the Service Fees prior to the arrival date. In the event the Owner for any reason whatsoever fails to pay the Service Fees prior to the arrival date, the Owner shall do so within fourteen (14) days of receiving an invoice from the Furmummy. The Furmummy shall be entitled to charge interest at a rate of 10% per annum calculated on the basis of a 365-day year on unpaid invoices upon expiry of the fourteen (14) days referred to above.
  3. GENERAL: This Agreement contains the entire agreement between the parties. All terms and conditions of this Agreement shall be binding on the spouses, heirs, administrators, personal representatives and assignees of Owner.
  4. INDEMNITY: Owner hereby covenants and undertakes to indemnify and hold Furmummy and their respective officers, managers, partners, agents, employees, controlling persons, members and any other person affiliated with any of them (collectively known as the “Indemnified Parties”) harmless against any damages, losses, liabilities, claims, actions, proceedings, costs (including legal costs on a full indemnity basis as well after as before judgment) and expenses which Indemnified Parties may suffer or incur relating to, in connection with, arising from any and all services provided by Furmummy.
  5. OVERNIGHT BOARDING CHECK-IN & CHECK-OUT TIME: Check-in time is after 9:00am and check-out time is before 12:00pm. Late check-out from 12:00pm to 7:00pm is subjected to a fee of $10 per hour or part thereof after 12:00pm, up to a maximum of $55.00 up to 7:00pm of check-out day. Late check-out after 7:00pm shall be considered overnight boarding service where one additional night stay shall be chargeable to Owner. Rates for overnight boarding is variable and subject to room size Owner booked previously for Pet, availability and holiday seasons.
  6. DAYCARE CHECK-IN & CHECK-OUT TIME: Check-in time is after 7:00am (Weekdays excluding Public Holidays), 9:00am (Weekends and Public Holidays) and check-out time is before 7:00pm. Late check-out after 7:00pm shall be considered overnight boarding service where one additional night stay shall be chargeable to Owner. Rates for overnight boarding is variable and subject to room availability and holiday seasons and updated on Furmummy’s website from time to time. Further, Public Holidays refer to MOM designated national Public Holidays.
  7. CANCELLATION POLICY: In the event the Owner wishes to cancel or amend overnight boarding service, notice to Furmummy must be made no less than seven days prior to Pets arrival date in order for Owner to be entitled to a full refund. In the event an Owner fails to check-in the Pet on arrival date (“No-show”), the full invoiced amount shall be payable by the Owner. Further, in the event of No-show, or cancellation of bookings made within seven days of arrival date, deposits paid upfront by Owner shall be forfeited absolutely.
  8. ABANDONMENT: If Pet is not collected by Owner (or an authorized representative of Owner) within seven calendar days after departure date, Owner is deemed to have irrevocably given notice to Furmummy that Pet is abandoned and Pet shall be disposed of at an adoption exercise or private or public sale, and Owner specifically waives all statutory or legal rights to the contrary. Notwithstanding the deemed abandonment as aforesaid, Owner shall remain liable for all fees due and, in addition, agrees to pay all costs incurred by Furmummy in the event of prosecution against the Owner.
  9. ACTS OR BEHAVIOUR: Owner agrees to be solely responsible for any and all acts or behaviour of Pet while in the care of Furmummy, including payments of costs of injury to Furmummy employees, Pets or damage to facilities caused by Pet. Owner also understands that squirt bottles, citronella spray and, in extreme cases, muzzles may be used for the protection of other pets or employees.
  10. DISPUTE RESOLUTION: This Agreement is governed by, and shall be construed in accordance with, the laws of Singapore and the parties hereto hereby submit to the exclusive jurisdiction of the Singapore Courts
  11. ASSUMPTIONS OF RISK: Furmummy agrees to exercise reasonable care of Pet during its stay. Owner understand and agree that Indemnified Parties are not veterinarians and do not have backgrounds in animal medicine and are not expected to diagnose or detect illnesses or injuries in the pets at Furmummy.

    Owner agrees and acknowledges:

    1. that no amount of vaccination requirement, sanitation or personalized care can prevent pets from contracting an airborne virus or communicable diseases;
    2. that pets, being pack animals, lead with their teeth, paws/claws, are unpredictable in nature, scrapes and puncture wounds can be a result of play and not necessarily aggression and no amount of supervision can provide absolute certainty to prevent pets from being injured. Owner agrees to be responsible for all damages and medical treatment for all injuries to Pet. Owner also understands and acknowledges that if an injury is proven to have occurred due to unprovoked aggression, owner of aggressive pet is responsible for medical treatment of injured pet;
    3. if Owner requests to board Pet together with other Pets belonging to the same Owner (“family members”) in the same room, Owner acknowledges and understands that regardless of the amount of supervision, such an arrangement may decrease Furmummy’s ability to detect issues, diseases and illnesses. Furthermore, because actions of pets may be unpredictable, owner is aware that this arrangement may also significantly increase the chance of injury, aggression and/or alterations;
    4. that Incidents that arises entirely out of the control of Furmummy can also cause serious injury, illness or death of pets including but not limited to impact trauma from traffic accidents or falls, malfunctioning of pet leashes, collars or harnesses resulting in escape or suffocation, electrocution by chewing on live wires or electrical equipment, falling tree branches or parts or fruits (durians and coconuts), insect stings or pet’s allergic reaction to stings, food poisoning from consumption of discarded food or waste, use of criminal force by parties outside the control of Furmummy.
    5. the Services Furmummy provides have inherent risks which may result in serious injury, illness or death of Pets. Owner agrees to hereby exempt, release and waive all rights to claim against Indemnified Parties from all liability or responsibility whatsoever for property damage, pet injury or death however caused, including but not limited to the negligence of the Indemnified Parties, whether passive or active.
  12. MEDICAL ATTENTION: In the event of injury, emergency or when Furmummy, in its sole discretion, deems medical care is important to Pet’s health (including, but not limited to: vaccinations, fleas, ticks, diarrhoea, rashes, etc), Owner authorizes Furmummy to obtain medical attention for Pet from our panel of preferred veterinarians.
  13. In such event, Owner is deemed to have appointed Furmummy and Furmummy preferred veterinarians as Owner’s attorney with the full power of decision-making involving the medical treatment of Pet (including but not limited to: consultation, medicine, surgery, hospitalisation, intensive care life support, anaesthesia, euthanasia, supplies, transport and care to and from any agent) and agrees to pay for all costs associated with said medical treatment.
  14. Owner agrees that Furmummy can only pay upfront, on behalf of the Owner, a maximum quantum of Singapore Dollars $200.00 to any veterinarian in any event. Owner further agrees that if deposit or fee required by any veterinarian exceeds maximum quantum Furmummy is able to provide upfront, Owner is required to pay the entire sum as detailed by said veterinarian. Furmummy will not engage any veterinarian or medical services that exceeds Furmummy’s maximum quantum of Singapore Dollars $200.00 prior the Owner’s direct settlement and/or upfront deposit payments for the engagement of veterinarian or medical service.
  15. PRE-PAID PACKAGES: In the event Owner decides to purchase a pre-paid package for services, Owner understands such sale price is offered at a special discount in exchange for a non-refundable commitment to use all the pre-paid packages at Furmummy.
  16. Owner further understands that subsequent to the purchase of pre-paid packages, circumstances may arise that are out of control of Furmummy including but not limited to: the death of Pet, the relocation of Owner, behavioural changes in Pet, and the decision to stop utilizing Furmummy for services.
  17. In such event, any unused portion of the sale (after amount of utilized services at regular standard rates) shall be transferrable for use on other services at Furmummy, but under no circumstances are the pre-paid packages refundable. Pre-paid packages may not be sold or transferred to any other person, entity or parties without the prior written consent of Furmummy.
  18. COMPLIANCE: Owner agrees to comply with the terms and conditions of Furmummy, which may be revised from time to time on Furmummy’s website.
  19. RIGHTS OF THIRD PARTIES: The Contracts (Rights of Third Parties) Act shall not apply to this service agreement and unless specifically herein provided no person other than the parties to this service agreement shall have any rights under it nor shall it be enforceable by any person other than the Owner and Furmummy
  20. LIMITATION OF LIABILITY: Furmummy does not give any warranty as to the Services. Whilst Furmummy shall endeavour to complete the Services, Furmummy shall not be liable to the Owner or any third party by reason of any delay, loss or damage howsoever arising out of or in connection with the provision of the Services.
  21. In no event shall Furmummy be liable for any special, consequential, incidental, punitive, exemplary direct or indirect losses or damages whether in contract or tort arising from the supply of the Services or the performance or non-performance of its obligations hereunder.
  22. Without prejudice to the generality of the foregoing, Furmummy's total liability to the Owner for any claim arising out of the Services shall be limited to $200, regardless of the number of Pets left to the care of Furmummy.

Service Agreement (Grooming)

  1. DISCLOSURE: For the purposes of this Grooming Service Agreement (“Agreement”), the terms “Pet” or “Pets” refer to all pets under the ownership of Owner who utilises the services at Furmummy (“Services”).
    By signing this Agreement and leaving Pet with Furmummy, Owner warrants and represents to Furmummy that all information provided to Furmummy orally or in writing about the Pet including without limitation information relating to health, satisfaction of pre-arrival checklist and sole ownership of the Pet is accurate in all respects and further acknowledges that this is a continuing warranty and representation that shall be deemed repeated each time his Pet is brought to Furmummy. For the avoidance of doubt, the warranties, representation terms and conditions in the pre-arrival checklist shall be deemed to be incorporated into this Agreement by reference.

  2. RATES: The rates quoted on the invoices issued to Owner are based on the breed, size, fur condition and behaviour of Pet (“Service Fees”) by Owner’s description or photo reference. Rates are subject to change as a result of actual breed, size, fur condition and behaviour of Pet on arrival/during grooming process, and/or changes in appointment dates and time, and updated on Furmummy’s website or correspondence from time to time.
    Furmummy reserves the right to refuse/stop services for such pet(s) at any time before or during the grooming process, charge a handling fee for aggressive and/or hyperactive Pet, and matt removal fees for Pet with matted fur in addition to the quoted grooming charge. Rates quoted are in Singapore Dollars. Rates do not include any applicable prevailing government taxes at time of service.

    (a) any and all services provided by Furmummy;
    (b) any breach by the Owner of any warranty, representation, term or condition of this Agreement;
    (c) any matter or thing arising from this Agreement.

  5. LATE & COMPLETION TIME: If unforeseen circumstances cause Furmummy groomer to be late, Furmummy will call and make arrangements for a later discharge. Pet is expected to be picked up as subsequently scheduled. If Owner cannot make the agreed upon time, please call Furmummy to alter appointment schedule accordingly. Pets not picked up 30 minutes after the scheduled time, will incur supplementary daycare charges starting from $10 per hour. Every effort will be made to keep our scheduled grooms running smoothly. A typical pet groom can be completed in 2 to 5 hours from the time of appointment. If pet has behavior issues or skin and coat problems Owner shall expect a longer period of time for rendering services. If Owner requires pet returned by a certain time, Owner must inform Furmummy prior to the groom. Furmummy do not provide waiting facilities on-site for Owner. It is not recommended that Owner arrives early before Pet grooms are complete.

  6. CANCELLATION POLICY: In the event the Owner wishes to cancel or amend groom appointment, notice to Furmummy must be made no less than three days prior to Pets arrival date in order for Owner to be entitled to a full refund of booking deposit (if any). Further, in the event of No-show, or cancellation of bookings made within three days of arrival date, deposits paid upfront by Owner shall be forfeited absolutely without any deduction, claim, counterclaim, set-off by Owner.

  7. ABANDONMENT: For Pets not collected by Owner (or an authorised representative of Owner) within seven calendar days after departure date and after three (3) written reminders are given to the Owner, Owner is deemed to have irrevocably given notice to Furmummy that Pet is abandoned and Pet shall be disposed of at an adoption exercise or private or public sale, and Owner specifically waives all statutory or legal rights to the contrary. Notwithstanding the deemed abandonment as aforesaid, Owner shall remain liable for all fees due and, in addition, agrees to pay all costs incurred by Furmummy in the event of prosecution against the Owner.

  8. ACTS OR BEHAVIOUR: Owner agrees to be solely responsible for any and all acts or behaviour of Pet while in the care of Furmummy, including payments of damages, losses, liabilities, claims, actions, proceedings, costs (including legal costs on a full indemnity basis as well after as before judgment) and expenses arising from injury to Furmummy employees, other Pets or damage to facilities caused by Owner’s Pet. Owner also understands that muzzles and crate may be used by Furmummy for the protection of other pets or employees.

  9. DISPUTE RESOLUTION: This Agreement is governed by, and shall be construed in accordance with, the laws of Singapore and the parties hereto hereby submit to the exclusive jurisdiction of the Singapore Courts.

  10. VOLUNTARY ASSUMPTION OF RISK: While Furmummy agrees to exercise reasonable care of Pet during its grooming. Owner understands and agrees that the Indemnified Parties are not veterinarians and do not have backgrounds in animal medicine and are not expected to diagnose or detect illnesses or injuries in the pets at Furmummy.
    Owner agrees and acknowledges:
    (a) that no amount of vaccination requirement, sanitation or personalised care can prevent Pets from contracting any communicable diseases and/or microbial infections;
    (b) that grooming equipments have sharp edges and while extreme caution and care are practiced in all situations, possible injuries could occur including cuts, nicks, scratches, quicking of nails, etc.
    (c) that unbeknownst to Owner, Pets may have pre-existing, undiagnosed and/or underlying conditions prior engaging Furmummy grooming services and it is not possible to exhaustively identify all conditions before, during and after grooming services. Furmummy shall inform Owner as Furmummy Groomers identify any such conditions that require Owner’s decision to proceed further with Furmummy grooming services, and that Furmummy cannot be held responsible for any of Pets’ pre
    existing, undiagnosed and/or underlying conditions.
    (d) that excessive matting can be avoided with regular brushing and grooming. In the event where mat removal service is required, Owner understands that neglect to Pet's fur coat can cause medical conditions such as mould, fungus or bacteria growth, resulting in skin irritations. De-matting is a painful and time-consuming process that can cause discomfort to pet and may result in nicks, cuts or abrasions. After effects of mat removal procedures can include and not limited to itchiness, skin redness, self-inflicted irritations or abrasions and bald patches. Mats can be very difficult to remove and may require the pet to be shaved. Shaved pets are prone to sunburn and should be kept out of the sun until their fur coat have grown sufficiently to protect the skin. In some cases, pets may also exhibit behavioral changes.
    (e) that Furmummy cannot be held responsible for development of new adverse conditions after the grooming service and it is Owner’s responsibility to ensure his newly groomed Pet is cared for as required including but not limited to the avoidance of direct sunlight, avoidance of excess stimulation and unsanitary environments including but not limited to bushes, grass, tarmac, roads that may increase the likelihood of microbial infections.
    (f) that shave downs or custom cuts that are outside normal specific breed haircuts will be discussed and the groomer will perform the cuts to the best of his/her understanding of client’s directions and his/her ability but no other guarantee is made. Shaving of your pet may dramatically change your pet’s appearance.
    (g) that Pets, being pack animals, lead with their teeth, paws/claws, are unpredictable in nature, scrapes and puncture wounds can be a result of play and not necessarily aggression and no amount of supervision can provide absolute certainty to prevent Pets from interacting with each other and/or being injured during Furmummy grooming services. Owner agrees to be responsible for all damages and medical treatment for all injuries to Pets. Owner also understands and acknowledges that if an injury is proven to have occurred due to unprovoked aggression, Owner of aggressive pet is responsible for medical treatment of injured Pet;
    (h) that incidents that arise entirely out of the control of Furmummy can also cause serious injury, illness or death of Pets including but not limited to impact trauma from traffic accidents or falls, malfunctioning of pet leashes, collars or harnesses resulting in escape or suffocation, electrocution by chewing on live wires or electrical equipment, falling tree branches or parts or fruits (durians and coconuts), insect stings or pet’s allergic reaction to stings, food poisoning from consumption of discarded food or waste, use of criminal force by parties outside the control of Furmummy.
    (i) the Services Furmummy provides have inherent risks which may result in serious injury, illness or death of Pets. ENTIRE AGREEMENT: This Agreement contains the entire agreement between the Parties with respect to its subject-matter and all previous written or oral understandings/ discussions/ representations/ correspondences and communications between the Parties relating to the matters covered by this Agreement are superseded and cancelled completely.

  15. RIGHTS OF THIRD PARTIES: The Contracts (Rights of Third Parties) Act shall not apply to this service agreement and unless specifically herein provided no person other than the parties to this service agreement shall have any rights under it nor shall it be enforceable by any person other than the Owner and Furmummy.

  16. IMITATION OF LIABILITY: Furmummy does not give any warranty as to the Services. Whilst Furmummy shall endeavour to complete the Services, Furmummy shall not be liable to the Owner or any third party by reason of any delay, loss or damage howsoever arising out of or in connection with the provision of the Services.
    In no event shall Furmummy be liable for any special, consequential, incidental, punitive, exemplary direct or indirect losses or damages whether in contract or tort arising from the supply of the Services or the performance or non-performance of its obligations hereunder.
    Without prejudice to the generality of the foregoing, Furmummy's total liability to the Owner for any claim arising out of the Services shall be limited to $200.00, regardless of the number of Pets left to the care of Furmummy.
